Houston Offshore & Maritime Injury Attorney
Offshore Injuries & Maritime Accidents in Texas
Over time, the United States has expanded laws to protect offshore and maritime workers. Specifically, these laws hold employers accountable when workers are injured on the job or in relation to their work.
At Vaughan Legal Trial Team, our Houston offshore and maritime injury attorney, Jeffery Vaughan, has extensive experience helping injured workers and their families fight for the justice they deserve. Our team is well-versed in laws protecting seamen, longshore workers, harbor workers, and others, including the Jones Act, the Longshore and Harbor Workers’ Compensation Act (LHWCA), and more. We have helped countless individuals recover the fair compensation they were owed and, to date, have collected more than $100 million in compensation for our clients.
What Is the Jones Act?
The Jones Act is a section of the Merchant Marine Act of 1920, which regulates commerce in U.S. waters and ports. In addition to governing coastwise trade (also known as “cabotage”), the Jones Act provides certain protections for maritime workers.
Under the Jones Act, injured seamen and other maritime workers are allowed to bring claims against employers when their injuries result from the negligence of a ship owner or unseaworthiness of a vessel. This includes negligent acts or conduct by captains and fellow crewmembers. This means that if you were injured in the course of your employment, and you believe your employer or another party was to blame, you may be eligible to seek monetary damages.
Common maritime incidents that may give rise to claims under the Jones Act include:
- Slips, trips, and falls aboard vessels
- Falls from heights to lower levels
- Coworker negligence or misconduct
- Failing to remove or discipline a worker for misconduct
- On-board equipment- and machinery-related accidents
- Improper ship or vessel maintenance, leading to unsafe conditions
- Improper or inadequate crewmember training
Notably, you are only required to prove that your employer’s negligence played some role in your injuries, regardless of how significant a factor this negligence was, to have a claim under the Jones Act.
